



Participation & Model Release Form
Introduction and Scope
Worthing4Refugees is pleased to offer you and your family a free headshot and family photo session. There is no cost to participate, and all resulting photos will be provided to you digitally.
To participate, you and your family simply need to be ready to have your photos taken and agree to the terms and conditions below.
By signing this form, the adult signatory confirms they are the parent or legal guardian and grant consent for themselves and for all minors listed below. The term “Model” used throughout this document refers to all individuals photographed under this agreement (the adult signatory and any minor children/wards).
Please note there is no financial remuneration for participation in this project.
All personal information collected is kept secure. Information that could precisely identify you or your family (such as full name or contact details) will never be published.
Crucially, photos of your children (minors under 18) will only be published with your express, written consent as detailed in the signature section below.
You maintain your rights under data protection law and may request to have your personal information (including the photo itself) amended or deleted at any point by emailing contemporaryheadshot@gmail.com
Legal Background and Purpose
A Model Release Form (this form) establishes a contract between the photographer and the model (you), defining how and where photographs may be used. It protects both the photographer and the sitter in the event of any dispute – provided the parties have abided by the terms of the release.
The law in relation to the right to use a person’s photographic image is not codified in one simple English law. Whilst the copyright in any photographs taken of a person will almost always vest in the photographer (or the photographer’s employer), potential laws under which a person might be able to prevent publication include:
- Section 85 of the Copyright, Designs and Patents Act 1988.
- The Data Protection Act 2018 (the “DPA”) (which implements the EU’s General Data Protection Regulation (EU 2016/679) into UK law). An image, particularly used in association with the person’s name, could amount to personal data and therefore use without the Model’s consent could amount to a breach of the DPA.
- Breach of confidence/privacy case law.
- The law of contract.
To ensure that the photographer can lawfully use the photographs taken of the person for the purpose the photographer requires, consent should be obtained from the Model/Parent/Guardian, and this is the primary purpose of this model release form.
English law will be used to determine any dispute involving this model release form.
Parties & Definitions
Photographer: The Contemporary Headshot
The Model: The person(s) being photographed, which includes the adult signatory and any minor children/wards listed in the consent section below.
Photographs: The photographs taken of the Model(s).
Project: Free photoshoot for Worthing4Refugees
Engagement
The Model agrees with the Photographer to the Consent, the Assignment/Waiver/Agreement, and Other Provisions below in return for:
- Free & full use of photos delivered in a digital format.
Consent
The Model irrevocably consents to the Photographer using the Photographs for the following purposes:
- Public display (in the context of an exhibition either online or at a physical location). This is without names or identifiable data
- Portfolio display (e.g. on the photographer’s website). This is without names or identifiable data
- Publication in any media (paper & digital). This is without names or identifiable data
Locations
The Model irrevocably consents to the Photographer using the Photographs in the following locations:
- United Kingdom & Worldwide. This is without names or identifiable data
Assignment/Waiver/Agreement
Subject to the Restrictions below (if any), the Model:
- Assigns to the Photographer any interest in the copyright in the Photographs that the Model may have.
- Waives any right to any future payment for the use of any of the Photographs for any purpose to which the Model has consented. The Model acknowledges that this waiver of payment also applies to any minors for whom they are giving consent.
- Agrees that the Photographs may be altered or modified in any manner using editing software.
Restrictions
- The Photographs shall not represent the Model in any derogatory manner.
- The Model (adult or minor) will never be publically named in association with a photo
- The Model (minor) photo will never be published without the express authorisation of the parent or legal guardian
Other Provisions
- The Model agrees that the terms of this Model Release Form are for the benefit of the Photographer and any licensee or assignee of the Photographer.
- By signing this form, the adult signatory confirms they are at least 18 years old and are the legally authorised parent or guardian of all minors to be photographed, with the full authority to grant consent on their behalf.
- This Model Release Form shall be governed by English law.
- The Model has the right to exercise its rights as a data subject under the DPA/GDPR at any time by writing to the Photographer at contemporaryheadshot@gmail.com
- The withdrawal of consent may be exercised by the adult signatory on behalf of any minor Model. Such withdrawal of consent will result in the images of the minor Model being removed from the Photographer’s current control (e.g., website, current exhibit) but cannot reverse use that occurred prior to the withdrawal.
- The Photographer is the data controller and responsible for the personal data comprising the Photograph and the Model’s contact details and any related personal data. See Privacy Policy
- The Photographer will (i) ensure that it complies with the requirements of all legislation and regulatory requirements in force from time to time relating to the use of the Photograph and your contact details and any related personal data; and (ii) process the Photograph and your contact details and any related personal data in accordance with the privacy policy.
